Once you sign up or register for our services, you will be required to provide us with your personal and or sensitive information such as your name, address, contact number, date of birth your employment status and other personal or sensitive information, based on your unique needs and the services we offer. Your personal or sensitive information will be collected by our Partnership Coordinate/Data Processor and, thereafter, processed by our Data Controller/Risk Manager.

The information that is collected and processed will be used by Esther for the following purposes: to match borrowers to lenders and lenders to borrowers; to open customers’ accounts with our deposit taking institution (DTI); to facilitate the movement of funds, whether investments or loans; to obtain credit reports on customers from our affiliate, authorized to operate under the Credit Information Act; and to ensure that Esther is in compliance with statutory provisions such as the Data Protection Act, Proceeds of Crime Act, Financial Investigation Division Act, Terrorism Prevention Act, the Money Lending Act and any other provision relevant to the services we offer.

We are required, under the Data Protection Act, to store all personal or sensitive information collected and processed. Therefore, please take careful note that personal and sensitive information may be stored in our database for a period of up to seven (7) years. Thereafter it will be destroyed. Your personal information will be disclosed to our affiliates or subcontractors, who are signees to a Non-Disclosure Agreement (NDA) to safeguard unwarranted disclosure of your personal or sensitive information.

Under the Data Protection Act, Proceeds of Crime Act, Financial Investigation Division Act and the Terrorism Prevention Act, we may be required to disclose your personal and/or sensitive information to agencies or statutory bodies authorized to regulate the statutory provision set out herein. In some instances, we will seek your consent to disclose your information; however, in order for us to be in compliance with some statutory provisions, we may disclose your information without notice to you or without your consent. Our failure to ensure that we operate in accordance with the statutory provisions governing our industry will lead to the enforcement of legal fines and /or penalties of up to One Million Dollars or more against us.
